Potvrzen\u00ed prod\u00e1vaj\u00edc\u00edch<\/h2>\n<p>T\u00edm, \u017ee Prod\u00e1vaj\u00edc\u00ed poskytne vozidlo spole\u010dnosti OPENLANE Europe k prodeji, prohla\u0161uje a zaru\u010duje u ka\u017ed\u00e9ho vozidla n\u00e1sleduj\u00edc\u00ed:<\/p>\n<ul>\n<li>Prod\u00e1vaj\u00edc\u00ed je vlastn\u00edkem vozidla a m\u00e1 k n\u011bmu ve\u0161ker\u00e1 pr\u00e1va, a to bez jak\u00fdchkoli z\u00e1stavn\u00edch pr\u00e1v \u010di zat\u00ed\u017een\u00ed, n\u00e1rok\u016f, zaji\u0161\u0165ovac\u00edch pr\u00e1v nebo pr\u00e1v t\u0159et\u00edch osob, mimo jin\u00e9 v\u010detn\u011b: exekuce, zadr\u017eovac\u00edho pr\u00e1va, v\u00fdhrady vlastnick\u00e9ho pr\u00e1va, financov\u00e1n\u00ed, konfiskace nebo n\u00e1rok\u016f souvisej\u00edc\u00edch s kr\u00e1de\u017e\u00ed. Ke dni p\u0159evodu nen\u00ed na vozidle evidov\u00e1no \u017e\u00e1dn\u00e9 neuhrazen\u00e9 financov\u00e1n\u00ed. Prod\u00e1vaj\u00edc\u00ed pln\u011b od\u0161kodn\u00ed, bude h\u00e1jit a zbav\u00ed odpov\u011bdnosti OPENLANE Europe za jak\u00e9koli ztr\u00e1ty, \u0161kody, n\u00e1roky, n\u00e1klady \u010di v\u00fddaje vznikl\u00e9 z nebo v souvislosti s jak\u00fdmkoli n\u00e1rokem t\u0159et\u00ed osoby t\u00fdkaj\u00edc\u00edm se Vozidla;<\/li>\n<li>Prod\u00e1vaj\u00edc\u00ed disponuje dokumenty k vozidlu (mimo jin\u00e9 v\u010detn\u011b: osv\u011bd\u010den\u00ed o registraci \/ technick\u00e9ho pr\u016fkazu a certifik\u00e1tu shody) a doru\u010d\u00ed je spole\u010dnosti OPENLANE Europe doporu\u010denou po\u0161tou. Pokud Prod\u00e1vaj\u00edc\u00ed nedisponuje osv\u011bd\u010den\u00edm o registraci nebo certifik\u00e1tem shody, informuje OPENLANE Europe p\u0159ed aukc\u00ed a neprodlen\u011b podnikne kroky k z\u00edsk\u00e1n\u00ed nebo oprav\u011b po\u017eadovan\u00fdch dokument\u016f tak, aby bylo mo\u017en\u00e9 uskute\u010dnit prodej. OPENLANE si vyhrazuje pr\u00e1vo vozidlo odm\u00edtnout nebo prodej zru\u0161it, pokud Prod\u00e1vaj\u00edc\u00ed neodstran\u00ed probl\u00e9my ve sjednan\u00e9 lh\u016ft\u011b;<\/li>\n<li>\u00dadaje v osv\u011bd\u010den\u00ed o registraci nebo certifik\u00e1tu shody odpov\u00eddaj\u00ed \u00fadaj\u016fm o vozidle. Informace o vozidle poskytnut\u00e9 Prod\u00e1vaj\u00edc\u00edm jsou pravdiv\u00e9 a \u00fapln\u00e9;<\/li>\n<li>Prod\u00e1vaj\u00edc\u00ed informoval OPENLANE Europe o v\u0161ech zn\u00e1m\u00fdch technick\u00fdch z\u00e1vad\u00e1ch vozidla, mimo jin\u00e9 v\u010detn\u011b nefunk\u010dn\u00edho tachometru\/odometru, a informoval OPENLANE Europe o jak\u00fdchkoli opraven\u00fdch \u0161kod\u00e1ch z nehody\/havarijn\u00edch \u0161kod\u00e1ch. Oprava mus\u00ed b\u00fdt deklarov\u00e1na bez ohledu na to, zda byla \u0161koda zp\u016fsobena koliz\u00ed, nehodou, pov\u011btrnostn\u00edmi vlivy nebo jinou ud\u00e1lost\u00ed. Vozidlo z\u016fstane bez jak\u00fdchkoli \u0161kod a vad s v\u00fdjimkou t\u011bch, kter\u00e9 jsou uvedeny v informac\u00edch o vozidle;<\/li>\n<li>Prod\u00e1vaj\u00edc\u00ed informoval OPENLANE Europe, zda se na vozidlo vztahuje re\u017eim DPH, nebo zda se uplatn\u00ed re\u017eim mar\u017ee (pokud p\u0159i po\u0159\u00edzen\u00ed vozidla nebyla uplatn\u011bna odpo\u010ditateln\u00e1 DPH);<\/li>\n<li>Prod\u00e1vaj\u00edc\u00ed bere na v\u011bdom\u00ed a zaru\u010duje, \u017ee p\u0159ed prodejem vozidla spole\u010dnosti OPENLANE p\u0159ezkoumal a pln\u011b dodr\u017euje ve\u0161ker\u00e9 p\u0159\u00edslu\u0161n\u00e9 m\u00edstn\u00ed, n\u00e1rodn\u00ed a mezin\u00e1rodn\u00ed pr\u00e1vn\u00ed p\u0159edpisy;<\/li>\n<li>Prod\u00e1vaj\u00edc\u00ed nese v\u00fdlu\u010dnou odpov\u011bdnost za to, \u017ee vozidla nab\u00edzen\u00e1 OL, jeho obchodn\u00ed praktiky a transakce jsou v ka\u017ed\u00e9 jurisdikci, ve kter\u00e9 p\u016fsob\u00ed, v souladu se z\u00e1konem. OPENLANE neodpov\u00edd\u00e1 za jak\u00e9koli poru\u0161en\u00ed povinnost\u00ed ze strany Prod\u00e1vaj\u00edc\u00edho;<\/li>\n<li>Prod\u00e1vaj\u00edc\u00ed potvrzuje, \u017ee si je v\u011bdom toho, \u017ee OPENLANE Europe se ve zna\u010dn\u00e9 m\u00ed\u0159e spol\u00e9h\u00e1 na informace, kter\u00e9 od Prod\u00e1vaj\u00edc\u00edho obdr\u017e\u00ed, pro marketingov\u00e9 \u00fa\u010dely vozidla, \u017ee u\u010dinil ve\u0161ker\u00e1 nezbytn\u00e1 opat\u0159en\u00ed k zaji\u0161t\u011bn\u00ed toho, aby OPENLANE Europe obdr\u017eela spr\u00e1vn\u00e9 informace, a p\u0159ij\u00edm\u00e1, \u017ee OPENLANE Europe nen\u00ed povinna poskytnut\u00e9 informace znovu ov\u011b\u0159ovat.<\/li>\n<\/ul>\n<\/div><\/div><\/div><\/div><\/div><div class=\"w-tabs-section\" id=\"openlane-europe-purchase\"><button class=\"w-tabs-section-header\" aria-controls=\"content-openlane-europe-purchase\" aria-expanded=\"false\"><div class=\"w-tabs-section-title\">N\u00e1kup OPENLANE Europe<\/div><div class=\"w-tabs-section-control\"><\/div><\/button><div  class=\"w-tabs-section-content\" id=\"content-openlane-europe-purchase\"><div class=\"w-tabs-section-content-h i-cf\"><div class=\"wpb_text_column us_custom_f03ee871\"><div class=\"wpb_wrapper\"><div class=\"pdfprnt-buttons\"><a href=\"javascript: imageToPdf(45102)\" class=\"pdfprnt-button pdfprnt-button-pdf\" target=\"_self\" ><span class=\"pdfprnt-button-title pdfprnt-button-pdf-title\">Vytisknout tuto sekci<\/span><\/a><\/div>\n<\/div><\/div><div class=\"w-separator size_small\"><\/div><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h2>3. Jakmile Prod\u00e1vaj\u00edc\u00ed prodej potvrd\u00ed, mus\u00ed vozidlo a jeho dokumenty p\u0159ipravit k vyzvednut\u00ed p\u0159epravn\u00ed spole\u010dnost\u00ed ur\u010denou OPENLANE Europe, nen\u00ed-li dohodnuto jinak. Prod\u00e1vaj\u00edc\u00ed nese odpov\u011bdnost a riziko po\u0161kozen\u00ed nebo odcizen\u00ed a\u017e do okam\u017eiku, kdy je vozidlo doru\u010deno a zkontrolov\u00e1no na sjednan\u00e9m m\u00edst\u011b dod\u00e1n\u00ed.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"w-tabs-section\" id=\"payment-and-invoicing\"><button class=\"w-tabs-section-header\" aria-controls=\"content-payment-and-invoicing\" aria-expanded=\"false\"><div class=\"w-tabs-section-title\">Platby a fakturace<\/div><div class=\"w-tabs-section-control\"><\/div><\/button><div  class=\"w-tabs-section-content\" id=\"content-payment-and-invoicing\"><div class=\"w-tabs-section-content-h i-cf\"><div class=\"wpb_text_column us_custom_f03ee871\"><div class=\"wpb_wrapper\"><div class=\"pdfprnt-buttons\"><a href=\"javascript: imageToPdf(45102)\" class=\"pdfprnt-button pdfprnt-button-pdf\" target=\"_self\" ><span class=\"pdfprnt-button-title pdfprnt-button-pdf-title\">Vytisknout tuto sekci<\/span><\/a><\/div>\n<\/div><\/div><div class=\"w-separator size_small\"><\/div><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h2>4. Nen\u00ed-li dohodnuto jinak, OPENLANE Europe uhrad\u00ed fakturu Prod\u00e1vaj\u00edc\u00edho a\u017e po obdr\u017een\u00ed potvrzen\u00ed o: (1) dod\u00e1n\u00ed vozidla na sjednan\u00e9 m\u00edsto, (2) inspek\u010dn\u00ed zpr\u00e1v\u011b a (3) obdr\u017een\u00ed dokument\u016f k vozidlu. Po \u00fahrad\u011b faktury Prod\u00e1vaj\u00edc\u00edho spole\u010dnost\u00ed OPENLANE Europe se OPENLANE Europe st\u00e1v\u00e1 vlastn\u00edkem vozidla a Prod\u00e1vaj\u00edc\u00ed bezodkladn\u011b provede pot\u0159ebn\u00e9 kroky k p\u0159evodu vlastnick\u00e9ho pr\u00e1va, je-li to vy\u017eadov\u00e1no.<\/p>\n<p>4.2. Neuhrazen\u00ed dluhu k datu splatnosti vede automaticky a bez p\u0159edchoz\u00ed v\u00fdzvy k n\u00e1sleduj\u00edc\u00edmu: (a) okam\u017eit\u00e9 splatnosti v\u0161ech neuhrazen\u00fdch faktur; (b) OPENLANE Europe m\u016f\u017ee dle sv\u00e9ho v\u00fdlu\u010dn\u00e9ho uv\u00e1\u017een\u00ed a ani\u017e by t\u00edm byla dot\u010dena jej\u00ed dal\u0161\u00ed pr\u00e1va, neprodlen\u011b: (i) pozastavit ve\u0161ker\u00e9 platby Prod\u00e1vaj\u00edc\u00edmu a jeho p\u0159\u00edstup k platform\u011b; (ii) zapo\u010d\u00edst jak\u00e9koli \u010d\u00e1stky dlu\u017en\u00e9 Prod\u00e1vaj\u00edc\u00edm (nebo kteroukoli jeho spojenou spole\u010dnost\u00ed) proti jak\u00fdmkoli \u010d\u00e1stk\u00e1m, kter\u00e9 m\u016f\u017ee OPENLANE Europe dlu\u017eit Prod\u00e1vaj\u00edc\u00edmu (nebo kter\u00e9koli jeho spojen\u00e9 spole\u010dnosti); (iii) v r\u00e1mci pou\u017eiteln\u00e9 lh\u016fty splatnosti \u00fa\u010dtovat Prod\u00e1vaj\u00edc\u00edmu \u00farok z prodlen\u00ed z dlu\u017en\u00fdch \u010d\u00e1stek bez p\u0159edchoz\u00edho ozn\u00e1men\u00ed, a to ve v\u00fd\u0161i \u00farokov\u00e9 sazby dle belgick\u00e9ho z\u00e1kona ze dne 2. srpna 2002 o opo\u017ed\u011bn\u00fdch platb\u00e1ch v obchodn\u00edch transakc\u00edch; (iv) zadr\u017eet jak\u00e1koli vozidla, dokumenty \u010di jin\u00e1 aktiva n\u00e1le\u017eej\u00edc\u00ed Prod\u00e1vaj\u00edc\u00edmu, kter\u00e1 m\u00e1 OPENLANE Europe ve sv\u00e9 dr\u017eb\u011b, dokud nebudou ve\u0161ker\u00e9 z\u00e1vazky zcela spln\u011bny; (v) prov\u00e9st novaci a\/nebo bilater\u00e1ln\u00ed a\/nebo multilater\u00e1ln\u00ed vypo\u0159\u00e1d\u00e1n\u00ed prost\u0159ednictv\u00edm zapo\u010dten\u00ed s jakoukoli spole\u010dnost\u00ed spojenou s Prod\u00e1vaj\u00edc\u00edm v\u016f\u010di OPENLANE Europe.<\/p>\n<p>Prod\u00e1vaj\u00edc\u00ed a jeho spojen\u00e9 spole\u010dnosti odpov\u00eddaj\u00ed spole\u010dn\u011b a nerozd\u00edln\u011b za ve\u0161ker\u00e9 dluhy v\u016f\u010di OPENLANE Europe.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"w-tabs-section\" id=\"openlane-europe-cancellation\"><button class=\"w-tabs-section-header\" aria-controls=\"content-openlane-europe-cancellation\" aria-expanded=\"false\"><div class=\"w-tabs-section-title\">Zru\u0161en\u00ed OPENLANE Europe<\/div><div class=\"w-tabs-section-control\"><\/div><\/button><div  class=\"w-tabs-section-content\" id=\"content-openlane-europe-cancellation\"><div class=\"w-tabs-section-content-h i-cf\"><div class=\"wpb_text_column us_custom_f03ee871\"><div class=\"wpb_wrapper\"><div class=\"pdfprnt-buttons\"><a href=\"javascript: imageToPdf(45102)\" class=\"pdfprnt-button pdfprnt-button-pdf\" target=\"_self\" ><span class=\"pdfprnt-button-title pdfprnt-button-pdf-title\">Vytisknout tuto sekci<\/span><\/a><\/div>\n<\/div><\/div><div class=\"w-separator size_small\"><\/div><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h2>5. Prod\u00e1vaj\u00edc\u00ed v\u00fdslovn\u011b bere na v\u011bdom\u00ed a souhlas\u00ed, \u017ee takto zm\u011bn\u011bn\u00e9 nebo nov\u00e9 OOP mohou b\u00fdt spole\u010dnosti OPENLANE Europe sd\u011bleny Prod\u00e1vaj\u00edc\u00edmu elektronicky, mimo jin\u00e9 e-mailem a\/nebo zpr\u00e1vou na Platform\u011b.<\/p>\n<p>11.3 Zm\u011bn\u011bn\u00e9 nebo nov\u00e9 OOP se pou\u017eij\u00ed a budou pova\u017eov\u00e1ny za Prod\u00e1vaj\u00edc\u00edm p\u0159ijat\u00e9 ode dne uveden\u00e9ho spole\u010dnost\u00ed OPENLANE Europe, leda\u017ee Prod\u00e1vaj\u00edc\u00ed v r\u00e1mci poskytnut\u00e9 v\u00fdpov\u011bdn\u00ed lh\u016fty p\u00edsemn\u011b ozn\u00e1m\u00ed spole\u010dnosti OPENLANE Europe, \u017ee odm\u00edt\u00e1 takto zm\u011bn\u011bn\u00e9 nebo nov\u00e9 OOP p\u0159ijmout. V takov\u00e9m p\u0159\u00edpad\u011b si OPENLANE Europe vyhrazuje pr\u00e1vo tyto OOP s okam\u017eitou \u00fa\u010dinnost\u00ed ukon\u010dit bez jak\u00e9koli n\u00e1hrady splatn\u00e9 ze strany OPENLANE Europe v t\u00e9to souvislosti a zablokovat p\u0159\u00edstup a pou\u017e\u00edv\u00e1n\u00ed Platformy Prod\u00e1vaj\u00edc\u00edm a jeho U\u017eivateli.<\/p>\n<\/div><\/div><\/div><\/div><\/div><div class=\"w-tabs-section\" id=\"miscellaneous\"><button class=\"w-tabs-section-header\" aria-controls=\"content-miscellaneous\" aria-expanded=\"false\"><div class=\"w-tabs-section-title\">R\u016fzn\u00e9<\/div><div class=\"w-tabs-section-control\"><\/div><\/button><div  class=\"w-tabs-section-content\" id=\"content-miscellaneous\"><div class=\"w-tabs-section-content-h i-cf\"><div class=\"wpb_text_column us_custom_f03ee871\"><div class=\"wpb_wrapper\"><div class=\"pdfprnt-buttons\"><a href=\"javascript: imageToPdf(45102)\" class=\"pdfprnt-button pdfprnt-button-pdf\" target=\"_self\" ><span class=\"pdfprnt-button-title pdfprnt-button-pdf-title\">Vytisknout tuto sekci<\/span><\/a><\/div>\n<\/div><\/div><div class=\"w-separator size_small\"><\/div><div class=\"wpb_text_column\"><div class=\"wpb_wrapper\"><h2>12. R\u016fzn\u00e9<\/h2>\n<p>Pokud bude n\u011bkter\u00e9 ustanoven\u00ed t\u011bchto OOP pravomocn\u011b ur\u010deno jako neplatn\u00e9, nez\u00e1konn\u00e9 nebo nevymahateln\u00e9, nebo se takov\u00fdm stane, bude toto ustanoven\u00ed, je-li to mo\u017en\u00e9, stranami nahrazeno platn\u00fdm, z\u00e1konn\u00fdm a vymahateln\u00fdm ustanoven\u00edm, kter\u00e9 co nejv\u00edce odpov\u00edd\u00e1 p\u016fvodn\u00edmu z\u00e1m\u011bru, a pokud to mo\u017en\u00e9 nebude, bude se pova\u017eovat za vypu\u0161t\u011bn\u00e9. Tyto OOP byly vyhotoveny v anglick\u00e9m jazyce a jejich ustanoven\u00ed budou vykl\u00e1d\u00e1na a uplat\u0148ov\u00e1na v souladu s rozhodn\u00fdm pr\u00e1vem uveden\u00fdm v bodu 8 a podle jejich obecn\u011b p\u0159ij\u00edman\u00e9ho v\u00fdznamu v angli\u010dtin\u011b. Jak\u00fdkoli p\u0159eklad t\u011bchto OOP slou\u017e\u00ed pouze pro pohodl\u00ed stran a nen\u00ed pro \u017e\u00e1dnou stranu z\u00e1vazn\u00fd. Pr\u00e1va a prost\u0159edky n\u00e1pravy kter\u00e9koli strany podle t\u011bchto OOP nebo v souvislosti s nimi mohou b\u00fdt vzd\u00e1ny (waived) pouze v\u00fdslovn\u00fdm p\u00edsemn\u00fdm ozn\u00e1men\u00edm druh\u00e9 stran\u011b.
